TERMS AND CONDITIONS OF THE INTERNET PORTAL

  • 1. Introductory Provisions
  1. The zonda.aero website of a limited liability company, available at https://zonda.aero ("Portal") is operated by zonda.aero a limited liability company based in Białe Błota, entered into the register of entrepreneurs of the National Court Register kept by the District Court in Bydgoszcz, 13th Commercial Division of the National Court Register under the number 0000431991, with the share capital of 700,000 PLN, NIP 5871699394, REGON 221735348.
  2. These Terms of Use are addressed to Users using the Portal's offer and define:
  3. a) the rules for using the Portal as part of the e-learning platform,
  4. b) the terms and conditions for submitting Orders via the Portal by electronic means,
  5. c) the rules and procedures for concluding Remote Service Agreements with the Client via the Portal.
  6. Customers can access these Terms of Use at any time at zonda.aero/regulamin
  7. These Terms of Use apply to the sale of Products carried out in the territory of the Republic of Poland and abroad - all over the world.
  • 2. Definitions
  1. Seller - zonda.aero a limited liability company with headquarters in Białe Błota, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bydgoszcz, 13th Commercial Division of the National Court Register under the number 0000431991, with share capital of 700,000 PLN, NIP 5871699394, REGON 221735348.
  2. Customer - an entity making purchases via the Portal.
  3. Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, the legal capacity of which is granted by a separate act, performing on its own behalf an economic activity that uses the Portal.
  4. Portal - an internet portal operated by the Seller at the internet address of https://zonda.aero.
  5. Terms of Use - the Terms of Use of the Portal, referred to in art. 8 of the Act of July 18, 2002 on the provision of electronic services.
  6. Privacy policy - Privacy policy and cookies, on the basis of which the Seller processes personal data of customers, available at the following internet address: https://zonda.aero/polityka-prywatnosci/
  7. Order - the Customer's declaration of will submitted via the Order Form and aimed directly at concluding the Product(s) Sales Agreement with the Seller.
  8. Registration form - a form available on the Portal that allows you to create an Account.
  9. Order form - an interactive form available on the Portal that allows placing an Order, in particular by adding Products to the Cart and defining the terms of the Sales Agreement, including the method of delivery and payment.
  10. Cart - an element of the Portal's software, in which the Products selected for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.
  11. Product - a service available and presented on the Portal which is the subject of the Sales Agreement between the Customer and the Seller.
  12. Sales Agreement - a contract for the sale of a Product or services concluded between the Customer and the Seller via the Internet Portal.

  5. The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.
  6. The customer may communicate by phone with the Seller between 9.00 a.m. and 3.00 p.m. Polish time (CEST).
  • 4. Technical requirements
  1. The use of the Website is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
  2. a) Internet Explorer version 7.8 or newer with JavaScript support enabled, Mozilla Firefox version 63 or higher, Google Chrome version 70 or newer,
  3. b) the minimum screen resolution of 1024 x 768 pixels.
  4. In order to use the Internet Portal, the Customer should obtain access to a computer station or terminal device with Internet access.
  5. The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions in the functioning of the Portal, caused by force majeure, unlawful actions of third parties or incompatibility of the Internet Portal with the Customer's technical infrastructure.
  • 5. General information
  1. Viewing the Portal's assortment does not require creating an Account. Placing orders by the Customer for Products offered on the Portal is possible by providing the necessary address data enabling the Order to be completed without creating an Account.
  2. In accordance with applicable law, the Seller, reserves the right to limit the provision of services via the Website:
  3. a) for persons under the age of 18. In this case, potential customers who do not meet the above conditions will be notified of the above limitation,
  4. Information about the Goods provided on the Portal's websites, in particular their descriptions and prices, constitute an invitation to conclude a contract, within the meaning of Art. 71 of the Civil Code and do not constitute an offer.
  5. The prices given in the Portal are given in Polish zlotys.
  6. The total (final) amount to be paid by the Customer consists of the price for the Product, as well as any additional fees related to the execution of the order, about which the Customer is informed on the Portal's pages when placing the Order, including when expressing the will to be bound by the Sales Agreement.
  7. The sales contract concluded between the Seller and the Customer is concluded in the currently selected language of the website (Polish or English).
  8. The law applicable to the resolution of any disputes between the Customer and the Seller is Polish law.
  9. The court responsible for resolving any disputes between the Customer and the Seller is the court holding jurisdiction of the Seller’s location.
  • 6. Rules for placing an Order and concluding an Agreement
  1. In order to place an Order:
  2. a) use the option of placing an Order without registration;
  3. b) select the Product that is the subject of the Order by adding it to the Cart;
  4. c) perform further technical activities based on the displayed messages and information available on the Website, in particular about paying for the order.
  5. When placing an Order - until the "Order" button is pressed - the Customer may modify the entered data and the Product selection. For this purpose, the Customer should follow the messages displayed and the information available on the Website.
  6. After the Customer using the Internet Portal provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
  7. a) the subject of the Order,
  8. b) unit and total price of the ordered Products and services and additional costs (if any),
  9. c) selected payment method,
  10. d) chosen method of delivery (if applicable).
  11. In order to send the Order, it is necessary to content to the Terms of Use, provide the data marked as mandatory and press the "Order" button.
  12. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with the Seller, in accordance with the Terms of Use.
  13. The seller will verify the data contained in the statement referred to in paragraph 5 and will determine the final price for the Products ordered.
  14. After placing the Order and its verification by the Seller, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
  15. The Order is accepted for execution after the Seller receives the payment for the ordered Product.
  16. The contract is treated as concluded at the moment of receiving the required payment from the Customer to the account specified in § 9 sec. 1 point a) of the Terms of Use or provided in the e-mail message referred to above. At this moment, the Seller will start processing the order.
  17. The payment deadline for the Order is a maximum of 14 days from the date of its confirmation by the Seller. Failure to pay for the Order within the above-mentioned period will result in the cancellation of the order by the Seller.
  • 7. Payment methods
  1. The customer can use the following payment methods:
  2. a) by bank transfer to the bank account number 23 1140 2004 0000 3812 1314 7808 or indicated in the e-mail referred to in § 7 sec. 6 of the Terms of Use,
  3. b) via the PayU.pl Portal, or other.
  • 8. Withdrawal from the contract
  1. By placing an order, the User agrees to commence the provision of services upon conclusion of the contract and thus declares that he resigns from his right to withdraw from the contract.
  2. If the User refuses to give his consent, the provision of services will start no earlier than after the expiry of the withdrawal period.
  3. In the case referred to in paragraph. 2 above, the User who is a consumer has the right to withdraw from the contract within 14 days from the date of its conclusion. A consumer wishing to withdraw from the contract submits a unilateral statement to the entrepreneur informing about the exercise of this right.
  • 9. Complaints regarding the provision of electronic services
  1. The Seller takes steps to ensure that the Website is fully operational, to the extent that results from the current technical knowledge and undertakes to remove any irregularities reported by the Customers within a reasonable time.
  2. The Customer is obliged to immediately notify the Seller about any irregularities or interruptions in the functioning of the Website Portal.
  3. Irregularities related to the functioning of the Portal may be reported by the Customer in writing, by e-mail to the address info@zonda.aero or using the contact form.
  4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Portal.
  5. Seller undertakes to consider each complaint within 30 days, and if it was not possible, to inform the customer during this period when the complaint will be considered.
  • 10. Personal data in the Internet Portal

The processing of clients' personal data is based on the Privacy Policy, the current wording of which is available at the following internet address: https://mdd.pl/polityka-prywatnosci/.

  • 11. Final provisions
  1. The Seller reserves the right to amend the Terms of Use at any time. The Seller will inform the Customer about each change at least 3 days in advance.
  2. In matters not covered by these Terms of Use, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of electronic services.
  3. These Terms of Use are valid from the date of their publication at the internet address: zonda.aero/termsofuse, i.e. from 30 July 2021.
